Terms & Conditions

The following terms of use apply to the use of and purchases from Offroad Supply LLC, ("Fat Bob's Garage") website at www.fatbobsgarage.com. The terms "you", "your", "yours" and "Buyer" refer to the user/customer utilizing our website, eBay Store(s), phone orders, or retail location(s) to purchase services or merchandise ("Product") or to browse our website. The terms "we", "us", "our" and "Seller" refer to Offroad Supply LLC, ("Fat Bob's Garage"). Our offer to sell the Products to Buyer is expressly limited to Buyer's acceptance to these terms and conditions. Receipt of any form of Payment or Purchase Order constitutes Buyer's unqualified acceptance of these terms and conditions. Additional or different terms or conditions (oral or written) proposed by Buyer shall be void unless accepted in writing by Seller. Agents and sales representatives of Seller have no authority to make any representations not included herein.

Return Policy

Uninstalled products may be returned within 15 days of purchase. "Fat Bob's Garage" is not responsible for return shipping or delivery on part returns. Shipping charges will not be refunded. All returns must be within 15 days of invoice date. A 20% restocking fee will apply to all returns. A 50% restocking fee will apply to all refused deliveries. Exchanges of equal or greater value may not be subject to a restocking fee. Special Order or Pre-Order Items are non-refundable. Contact us for details. Buyer assumes all liability for any damage that occurs on return shipment to Seller. Items must be packaged to withstand return shipment to Seller and Buyer assumes responsibility to verify that all items are secure and that damage will not occur.

An RMA# must be included with your return/exchange. To obtain an RMA#, please contact us at (801) 395-2134. Once you have an RMA#, you may return the product to us at:

PLEASE NOTE: The RMA# MUST be clearly visible on the return package.

Items without RMA Numbers or that were not preauthorized for return will be marked unclaimed for 30 calendar days. In this event, no contact attempts will be made by Seller to Buyer. After 30 calendar days the item(s) will be disposed of as seen fit by Seller. Should Buyer choose to have the product reshipped, payment for reshipment must be received within 30 calendar days from the date the item was marked as unclaimed.

International Shipments that are returned or abandoned as unclaimed will not be subject to a refund. Payment for reshipment must be received in order for Seller to reship the item(s).

RMA#'s are valid for 14 Days after the date they are issued. Items received after 14 days will be considered unclaimed.

Cancellations

International cancellations are subjected to additional shipping terms below.  Cancellation of unshipped orders are subject to a minimum 5% cancellation fee. Some vendors require us to bring product into our warehouse before we ship out. Cancellation of these orders are subject to shipping and return shipping fees as well as the 20% restocking fee. Disclaimer Of Warranty

Warranty on all FBG MFG products is 18 months and is replacement of part only for defects in materials and workmanship. No cash or compensation for labor will be given for defects in material and workmanship. Defective part must be returned in order for new part to be distributed.

OEM Part warranties are as listed by their respective manufactures. Warranties can change without notice. Some warranty claims must be filed directly with the manufacturer by Buyer.

Modifying your vehicle in any way, including the installation of parts sold on the Fat Bob's Garage website, MAY increase the risk of premature wear or damage to other components. Fat Bob's Garage is NOT responsible for any damage or premature wear to parts not purchased on the Fat Bob's Garage website, including but not limited to, stock components. These risks are considered common knowledge and may or may not be disclosed on each item description. The customer is solely responsible for researching the possible consequences of modifying a vehicle PRIOR to purchase.

Modifying your vehicle may or may not void the vehicle manufacturer's warranty. Fat Bob's Garage has no control over this, and further makes no guarantee as to whether or not a warranty may be voided. Consult your warranty.

Shipping Policy

Most in stock orders ship within 48 hours. If a product is backordered, then we will contact you with an estimated shipping date. Missing, incorrect, damaged, or misboxed parts must be reported within 5 days of order delivery.

Shipping charges are non-refundable. Return shipping charges are the responsibility of the buyer.

Once the package is in possession of the carrier (UPS, USPS, FedEx, Etc), we do not guarantee shipping and transit times and are subject to the individual terms of the carrier.

Special Order or Pre-Order Items are non-refundable.

Products marked as "Free Shipping" apply to orders shipped to the United States only, unless otherwise noted. For shipping quotes to locations outside of the United States, please contact us. In the case of a return, the actual shipping charges will be deducted from the refund amount.

In most cases, items shipped internationally must be brought into our warehouse for shipment outside the US. Once items are ordered to be brought into our warehouse(s) the item will be subject to any restocking fee charged by the prospective manufacturer. This fee may be in addition to charges outlined above. In the event of a cancellation or return, actual cost of shipping fees to our warehouse(s) will be deducted form the refund amount.

International Shipments that are purchased with the US Free Shipping and do not want to pay the additional shipping will be charged a 5.00% cancellation fee. Please contact us at (801) 395-2134 or sales@fatbobsgarage.com before purchase to avoid this fee.

Not all of our vendors ship directly to consumers and may have territorial restrictions. If you are purchasing BDS Suspension products and the product you purchased is not in stock we will have to bring it in to our warehouse. Once a purchase order for the product has been submitted to bring the product into our warehouse there will be a 20% restocking fee for any items canceled. Shipping these items may take longer, if your order is time sensitive please call customer service for assistance. Items not commonly stocked will be subject to a return freight charge. We reserve the right to ship by the best method possible.

Payment Types

We accept the following forms of payment for your online purchases: Visa, MasterCard, Discover, American Express, and PayPal. For your online purchases, you may purchase multiple products in a single order, and we'll accept one credit card and up to one Gift Card for each order.

We are unable to accept cash, checks and C.O.D. orders for any website purchases. If you would like to make a purchase using either cash or a check, please contact us.

We reserve the right to require wire transfer as a form of payment.

Sales Tax Policy

We do business throughout the United States and accordingly collect sales and use tax as required by applicable law. Your confirmation of your order total will reflect the applicable state and local sales tax, if any. The tax rate applied to your order will generally be the combined state and local rate for the address where your order was shipped, delivered or picked up.

For any online purchase of a tax-exempt item during a sales tax holiday period, by completing the purchase, you certify that the item is being purchased for personal use only and you agree to assume liability for the applicable tax if the item is used for other than personal use.

Payment

Payment is to be made before shipment of the item(s). Wholesale accounts may be set up at the sole discretion of Seller and are OAC. If payment is not received, is charged back, is disputed or returned in any way the following will occur:
1) $50 per hour Seller paperwork preparation fee
2) Late charge of one and one-half percent (1.5%) per month (eighteen percent (18%) per year) or the maximum legal rate, whichever is less, to unpaid invoices from the due date thereof.
3) 50% of balance Collections Fee by Seller
3) Collections and Legal Fees as charged by Collections Agency

Damaged, Defective, Incorrectly Shipped, and Missing Items

In the event that an item is missing from a shipment, Seller will ship the item utilizing the original shipping method that was selected by Buyer at the time of the original order.

In the event that an item is damaged or defective, Buyer must follow the return policy as indicated above. This includes obtaining an RMA# from Seller before returning the item. Replacement items will not be shipped until the defective item has been received by Seller and is inspected.

Replacement for damaged, defective, missing or incorrectly shipped items will be shipped via the original shipping method that was selected by Buyer at the time of the original order.

International Buyers

Import duties, taxes, customs clearance and other importing fees are not included in the item price or shipping cost. These charges are the buyer's responsibility. Please check with your country's customs office to determine what these additional costs will be prior to completing your purchase. Non-payment of these fees will not be grounds for a return and may result in abandoned shipment, no refund will be given.

International shipments may have longer than average delivery times, once an order has been shipped this is out of our control and is subject to country and local requirements. Delays will not be grounds for reimbursement or refund.
